the st. bernard parish school board are assholes.

you may be asking , "why?" well then read on...

they have a policy which requires that a parent or guardian have a custody judgment to enroll their kid in school, or the kid gets kicked out. (this applies basically to any kid in living in a situation which is not kid and both married parents) so if mom and dad are divorced or were never married and the kids live with mom, mom must get a custody judgment from a court or her kids will get kicked out of school. same for the kind grandma or aunt or whoever that generously takes care of their fucked up kid's or nephew's child. so what if mom or grandma can't afford to get a lawyer and go to court to get a judgment? their children get kicked the fuck out of the schools in st. bernard. then, as a special bonus, the authorities will go after the parent, grandparents, etc for truancy and threaten to arrest them cause the kids arent in school.
plus, (hold your breath for this one) the rumor is that st. bernard has this policy in place so that they can keep as many black kids out of the public schools as possible.

so here's a big FUCK YOU to the bastards on the st. bernard school board.

Is there any way to challenge this policy? What about under Sections 1, 3 or 12 of Article I of the Louisiana Constitution?

legal aid is tossing around the idea of a class action. don't know how likely that is or how soon it would be. the ACLU needs to get all up on this or something. its fucking outrageous.

Have you suggested that your clients drop by the ACLU office? Are you allowed to do that? Would someone from St. Bernard Parish go to the ACLU for help? I wonder how many cases the ACLU has pending there. . .

The ACLU isn't really a legal aid office so they can't really do client intake like that. Their phone number is a lengthy phone message that tells you to fill out a complaint report so its probably best to contact someone there directly like Joe Cook.

i don't know how that works, but i think they'd definately have a good equal protection arguement if someone wanted to litigate the issue in federal court. i told the attorneys i work with at legal aid that if legal aid wanted to do a class action or something i would volunteer to help with it. we'll see if that ever gets done.
